Mumbai: The Bombay High Court has denied the request for pre-arrest bail from a developer based in Mumbai who is accused of defrauding a doctor of Rs 90 lakh through a false promise of a flat in his project in Parsi Colony, Wadala (W). The court expressed concerns about potential additional victims. Justice N J Jamadar, on Aug 26, stated, "An innocent investor has been misled for a decade, with the applicant's dishonesty worsening the situation." The case involves Rajesh Jain of Neumac Group, who, in Jan 2012, convinced Dr Bharati Patil and Dr Nirmal to invest in 'Neumac Aura', assuring them a flat twice the investment amount. However, disappointingly, the allotted flat was nonexistent, leading to legal actions against Jain for breach of trust and cheating. Evidence presented includes photographs showing minimal construction progress and contradictions with Jain's claims. The Court emphasized the need to assess the developer's initial intentions and highlighted discrepancies in his statements regarding the project's status.The revised target for completion was set for June 30, 2024. Justice Jamadar emphasized the importance of recognizing the element of dishonest intention given the circumstances. He highlighted that the individual in question was attempting to deflect blame onto others for the delay and was seeking pre-arrest bail based on claims indicating an intent to deceive. The judge stated that it is essential for the individual to undergo interrogation while in custody.
